Changes in Illinois Home Seller Disclosure Requirements Are Now in Effect

It was a small item on the news the other day and you may have missed it, but Illinois Governor Quinn signed a law mandating some minor changes to two of the disclosure forms that most home-sellers are required to provide to buyers. These changes are effective immediately. They are as follows:

  • Residential Real Property Disclosure Report. Item 23 has been added, requiring the seller to disclose any knowledge that the property was used for the manufacture of methamphetamine.
  • Disclosure of Information on Radon Hazards. Article C of the seller’s disclosure has been expanded to require the seller to also disclose any knowledge of prior elevated radon concentrations that have been mitigated or remediated.

The Illinois Association of REALTORS® suggests that properties already under contract for sale, where the old disclosures were provided and the buyers signed them, do not need to provide the new forms. All other sellers are recommended to complete the new forms and make them available to all prospective buyers. Anyone who needs copies of the new forms can contact me.
